Judgment
IA-5402/2022: An application filed by the Financial Creditor under Section 12A seeking withdrawal of the main petition IB-406/ND/2021. Ld. Counsel appearing for the Applicant submits that the CoC has passed the requisite resolution for the withdrawal of the petition in its meeting dated 31.10.2022, with 100% voting share. Form-FA duly signed by the Financial Creditor has been placed at page No. 60 of the application. Ld. Counsel further submits that all the dues of the RP have been paid.
In the light of the averments made in the application and submissions made by the Ld. Counsel, we hereby allow the withdrawal of the petition IB- 406/ND/2021. Mr. Sanyam Goel, RP stands released and the Corporate Debtor is discharged from the rigors of the CIR process and is allowed to function from its regular Board.
With this, IB-406/ND/2021 stands closed.
IA-5402/2022 stands disposed of.
