ORDER

Ld. Counsel for the RP present.

IA(I.B.C)/1114(KB)2023

This IA has been field by RP in sec. 12A of the IBC, seeking withdrawal of C.P. (IB)/671(KB)2019 which was admitted by this Adjudicating Authority on 24.02.2023. Subsequently, COC was constituted. This IA duly supported by affidavit of RP at page 14, copy of minutes of 7th CoC have been placed on record at page 48-56. As per page 51, there is only one member of CoC and CoC has approved for filing of this application seeking withdrawal of CIRP under 12A of IBC, 2016.

In view of the above position, this IA is allowed in CIRP initiated vide order dated 24.02.2023 shall since to be in operation. It is stated that RP has been paid his dues full and final. The RP is discharged of its duties. RP shall hand over all the documents if any to the Corporate Debtor within two weeks from today. C.P. (IB)/671(KB)2019 shall stand disposed of accordingly.

This IA has been filed by RP for seeking exclusion of 90 days in completion of CIRP for the reasons mentioned in paragraph 4 and 5 of this IA. This IA accompanied by an affidavit of RP at page 14-15. Time taken for the reasons mentioned in the IA indicated above is excluded the time sought as mentioned excluded. Accordingly, this IA is allowed.
