Judgment
Rajes Kumar, J.
Sri S.P.Shukla, learned counsel for the petitioners states that even though requisite steps for issuance of notice to respondent no. 5 pursuant to the order dated 5th March, 2009, were taken by him on 7th March, 2009 but the relevant papers were not placed on record by the Office. The relevant papers however, have now been placed on record by the Office .
An application has also been filed on behalf of the petitioners for condoning the delay in taking requisite steps.
Delay in taking steps is condoned.
Office is directed to proceed.
Let the notice be issued to respondent no. 5 fixing on 20th April, 2009.
Counter affidavit on behalf of all the respondents may be filed on or before 17th April, 2009. Rejoinder affidavit may be filed by the date fixed in the matter.
List this case before the appropriate bench on 20th April, 2009.
Sri S.P.Shukla, learned counsel for the petitioners submits that in order to avoid delay in the matter, he may be permitted to take steps by speed post also in addition to the aforementioned steps already taken by him.
Let requisite steps be taken for issuance of notice to respondent no. 5 by speed post also in addition to the aforesaid notice.
Notice will be issued, as mentioned above, fixing 20th April, 2009. The requisite steps will be taken within 48 hours.
