Grievance in this application against new mining leases without requisite replenishment studies and updated District Survey Reports in terms of Enforcement & Monitoring Guidelines for Sand Mining, 2020.
Vide order dated 25.08.2022, this Tribunal considered the contentions in the application and sought a factual report from a joint Committee of District Magistrate, Hamirpur and SEIAA, UP. Notice was also issued to the project proponents to enable them to file their response, if any.
Accordingly, the joint Committee has filed its report as follows:-
“4- That the environmental clearances have not been received till today and areas are vacant till date and replenishment studies work are being conducted by Central Mine Planning & Design Institute Limited, Gondwana Place, Kanke Road, Ranchi 834031, Jharkhand and studies work is on progress and hope it is received soon.
5-That status report is being prepared on this day of 28th September 2022 on the basis of information provided by the Mines Officer, Hamirpur. Mines Officer, Hamirpur is required to sent the copy of this status report to the respondent nos. 5, 6 and 7. This status report should also be filed at the Hon'ble National Green Tribunal by the District Administration, Hamirpur.”
In view of above, since mining has not commenced, no further action is necessary at this stage.
The Application is disposed of.
I.A. No. 197/2022 will also stand disposed of.
