Heard Mr. P. Yobin, learned counsel for the petitioner. Also heard Dr. N. Mozika, learned DSGI appearing for the respondents/Union of India.
An elaborate argument has been made by both sides. However, the argument has almost touched the merits of the case. It may be reminded that the counter affidavit has not been filed by the respondents and, as such, pleadings are not yet completed.
The limited prayer of the petitioner at this point of time is for a stay of the opening of the bid which is scheduled today, that is, 31.07.2023. The Bid Number being GEM/2023/B/3622434 dated 27.06.2023.
This Court would not dwell into the merits of the submission made, but, would however direct that the opening of the bid which is fixed today, shall not in any way be hampered or stayed. It is, however, made clear that the final outcome of the tender process would be subject to the disposal of this writ petition.
As prayed for, counter affidavit be filed within 1(one) weeks’ time. List this matter thereafter.
