Heard Mr. S. Rupachandra, learned Sr. counsel appearing for the petitioner.
Issue notice.
Mr. Samarjit Hawaibam, learned GA accepts notice on behalf of the respondent nos. 4, 5 & 6.
Mr. S. Rupachandra, leaned Sr. counsel draws attention of this Court to the Annexures – A/3 & A/4 (running pages 12 to 17 of the petition) whereby the Manipur Minorities and OBC Economic Development Society (MOBEDS) inviting E-tender for the development of infrastructure for Manipur Technical University (MTU), Imphal West District vide order No. 01/MOBEDS/PM-DevINE/MTU/2024/01 dated 2nd July, 2024 and order No. 01/MOBEDS/PM-DevINE/MTU/2024/02 dated 2nd July, 2024 in which, in all the E-tender notices, it was mentioned that the last date of bid submission will be till 12(noon) of 15th July, 2024 and as the matter is so urgent that the notice cannot be served to the rest of the respondents and as such requested this Court to pass an interim order staying the operation of the E-tender notice No. 01/MOBEDS/PM-DevINE/MTU/2024/01 dated 2nd July, 2024 and order No. 01/MOBEDS/PM-DevINE/MTU/2024/02 dated 2nd July, 2024.
Mr. Samarjit Hawaibam, learned GA requested to take up the matter on another date in regard to interim order, as the main respondents i.e respondent no. 1, 2 & 3 are yet to appear before this Court.
However, on perusal of the E-tender notice No. 01/MOBEDS/PM-DevINE/MTU/2024/01 dated 2nd July, 2024 and order No. 01/MOBEDS/PM-DevINE/MTU/2024/02 dated 2nd July, 2024, the last date for online submission for bidding will be till 12 (noon) of 15th July, 2024. Since the opening of this High Court from summer vacation will be only on 17th July, 2024, it is ordered that till the next date of hearing (i.e. till 18.07.2024), the respondent no. 3 is directed not to open the bid submitted with respect to order No. 01/MOBEDS/PM-DevINE/MTU/2024/01 dated 2nd July, 2024 and order No. 01/MOBEDS/PM-DevINE/MTU/2024/02 dated 2nd July, 2024.
The learned counsel for the petitioner is directed to take steps to the respondent nos. 1, 2 & 3 by way of speed post as well as dasti service within 3(three) days.
List the matter on 18.07.2024 for consideration of interim order.
Copy of this order be furnished to both the learned counsel for the parties during the course of the day.
