Judgment
In the present OA filed under Section 19 of the Administrative Tribunals Act, 1985, the applicants have prayed for the following reliefs:
“i)to consider and sanction family pension to the applicant from the next date of the death of his mother (family pensioner died on 08.02.2022) with interest on the basis of available documents in terms of O.M. dated 08.12.2011 and other O.M.s issued by DoP&PW.
Central Administrative Tribunalii) to modify the P.P.O. and re- authorise family pension to the applicant as a dependent disabled child of the deceased employee.
iii) the Hon'ble Tribunal be pleased to grant any other relief as may deem fit and proper in the facts and circumstances of the case in the favour of applicant.”
Learned counsel for the applicant submits that initially, the father of the applicant, who had been an employee of the respondents, unfortunately expired. Thereafter, the applicant’s widowed mother started receiving family pension. Subsequently, a claim was made by the applicant’s disabled brother, namely late Mr. Ashok J. Ingle, who also unfortunately expired. In this background, the applicants have claimed the aforesaid benefits.
On the other hand, learned counsel appearing for the respondents on advance service submits that the documents sought from the applicant/his deceased brother, late Mr. Ashok J. Ingle, have not been supplied till date.
At this stage, learned counsel for the applicant invites our attention to the representation dated 11.12.2025 submitted by late Mr. Ashok J. Ingle to the Senior Divisional Personnel Officer, annexed as Annexure A-11. The English translation thereof is placed at page 42A of the paper book. The same reads as under:
“The Sr. Divisional Personnel Officer DRM Office, Personnel Branch Nagpur Sub: Regarding letter dated 27.11.24 by DRM office for submission of documents as per list from Srl. No. 1 to 14. Sir, My father Shri Jagannath Ingle was working in Loco Shed, Central Railway as Machinist. my father died on 01.02.1998 while working. As per your letter/ notice, I have document mentioned in Srl No. 3, 4, 5,6, 8, 11, 13, 14. Other documents in Srl. No. 1, 2, 7, 9, 10 is not available with me. I request you to kindly accept my application and please process the case.”
From the aforesaid, it is apparent that late Shri Ashok J. Ingle had himself admitted that the documents at Sl. Nos. 1, 2, 7, 9 and 10 were not available with him. In this background, it cannot be construed that all the documents were submitted by the applicant or his late brother before the respondents.
In view of the aforesaid, at the request of learned counsel for the applicant, the OA is disposed of at this very stage with the following directions:
The applicant shall be at liberty to submit all the relevant documents within eight weeks before the competent authority amongst the respondents, along with a fresh representation.
If such representation and documents are submitted by the applicant within the time stipulated, the competent authority amongst the respondents shall consider the same and dispose of the same as expeditiously as possible and preferably within ten weeks of receipt of such representation.
The OA stands disposed of in the aforesaid terms. No costs.
