Judgment
Grievance of the applicant is that malba/ waste material is being dumped behind the lane of T1, DLF, Phase – III, Gurgaon, Haryana. OA No. 27/2020 was filed before the Tribunal on which order dated 30.01.2020 was passed by the Tribunal and thereafter OA was disposed of vide order dated 17.07.2020 in the light of report that the waste material has been removed. However, there is non-compliance of directions of the Tribunal and waste material continues.
Considering the above, vide order dated 10.08.2022 a factual report was sought from a joint Committee of State PCB, District Magistrate, Gurgaon and the Municipal Commissioner, Gurgaon.
Accordingly, the Commissioner, Municipal Corporation, Gurgaon is present by video conference and has filed response dated 9.9.2022 to the effect that remedial action has been duly taken. The C&D waste in question stands duly removed. An agreement has been entered with a service provider and the said service provider is providing necessary services. Boundary wall is being constructed to prevent dumping of waste and action is being taken against the vehicles bringing waste to the site in question.
Even though the applicant remains unsatisfied, we do not find any tangible material to pass any further order.
The application is disposed of.
I.A. No. 230/2022 will also stand disposed of.
