Heard the parties.

This bail application under Section 438 Cr.P.C. has been preferred by the petitioner apprehending his arrest in connection with Patan P.S. Case No.02/2024, for the offences registered under Sections 188/ 379/ 411/ 34 IPC, U/R 21 Mines and Minerals (Development and Regulation) Act, 1957, U/r 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transporting and Storage) Rule, 2017. The case is pending in the Court of learned JMFC, Palamau.

As per the F.I.R., the petitioner is driver of Power Trac Tractor having Engine No.E3614614, Chassis No.T053547558AK and from the alleged vehicle, 80 C.F.T. sand has been seized.

Submission has been made by learned counsel for the petitioner that the petitioner has been falsely implicated in the present case. On this ground, he implored the Court to enlarge the petitioner on anticipatory bail.

Per contra, learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts, so also the fact that the alleged recovery has already been affected, I find it a fit case to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned JMFC, Palamau in connection with Patan P.S. Case No.02/2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
