Judgment
By Hon’ble Mrs. Jasmine Ahmed, Member (J);-
MA No. 2225/2018 filed for joining togetherwith is allowed.
The applicants have filed this OA under Section 19 of the Administrative Tribunal’s Act., 1985, seeking the following relief(s):-
(a)to quash and set aside the impugned orders dt.8.3.2018 (Ann.A-1 (Colly) and orders dated 16.4.2018 (Ann A-(Colly) directing the respondents to maintain the earlier status of the applicants with regard to in –situ promotion given earlier.
(b)to direct the respondents to withdraw the order dt. 16.4.2018 and 8.3.2018 passed by them in respect of applicants thereby directing the institute to take final view in terms of letter dt.6.2.2018 thereby seeking concurrence of Ministry of Finance for in-situ promotion.
(c)to pass any other or further relief which this Hon’ble Tribunal deems fit and proper in the facts and circumstances of the case and OA be allowed with all consequential benefits.
After hearing for some time, learned counsel for the applicants submits that he intends to prefer a fresh detailed comprehensive representation before the competent authority ventilating the grievance of the applicants. Accordingly, he is permitted to do so within seven days from today, and the respondents are directed to take a decision on the said comprehensive representation within six weeks from the date of receipt of the representation.
In view of the above, the OA is disposed of.
