In this writ petition, the petitioner has prayed for the following reliefs:-

(i) For direction upon the respondent authorities to pay the arrears of salary along with dearness allowance and other benefits i.e. house rent, gratuity, leave encashment, revised pension after granting the benefits of 6th pay revision, which mother of the petitioner was entitled for the said benefits from January, 2006.

(ii) For direction upon the respondent authorities to pay the arrears of general provident fund amount along with statutory interest, which the mother of the petitioner was legally entitled for till the date of payment.

(iii) For direction upon the respondents to pay the arrears of pension of the month of July, 2020 to the petitioner of his deceased mother.

(iv) For direction upon the respondents to pay penal interest upon the due amount.”

Heard learned counsel representing the petitioner and learned counsel representing the respondents.

As per the petitioner, the mother of the petitioner was an employee under the respondents, who died on 27.07.2020. It is the case of the petitioner that he is only the legal heir. The dues which the mother of the petitioner was entitled to receive, have not been paid, thus this petitioner has approached this Court.

Learned counsel representing the respondents submits that if the petitioner files a fresh representation, his case will be considered and an appropriate order will be passed.

Considering the aforesaid submission, I direct the petitioner to file a fresh representation annexing all the documents, before respondent No.3 – The General Manager-cum-Chief Engineer, Jharkhand Urja Sancharan Nigam Limited, Deoghar, within four weeks.

On receipt of such representation, the respondent No.3, will consider the representation of the petitioner and pass a reasoned order, within six weeks.

7.

If the petitioner is found entitled for any benefit, the same should be extended to him within two weeks thereafter.

8.

If any part of the claim / representation is rejected for any reason, a detailed speaking order should be communicated to the petitioner.

9.

With the aforesaid directions, this writ petition stands disposed of.
