Mr. Binod Kumar Jha, the learned counsel for the petitioners submits that O.P.no.2 has filed the complaint case before the learned court which has been sent to police under section 156(3) of Cr.P.C for registration and investigation and thereafter further investigation was made and final form has been submitted on 04.10.2015 in which the petitioners have not been sent up for trial. He submits that on the protest petition cognizance has been taken against the petitioners. Petitioner no.1 is wife of O.P.no.2 and O.P.Nos.2 and 3 are the father in law and mother in law respectively. He submits that now divorce has been taken place between the petitioner no.1 and O.P.no.2.
Let notice be issued upon the O.P.No.2 by registered post with A/d as well as under ordinary process for which requisites etc. must be filed within two weeks.
There shall be stay of further proceeding in connection with C/1 Case No.1855/2016, pending in the court of learned J.M., 1st Class, Jamshedpur, East Singhbhum, till the next date.
