Judgment
Heard Mr. T.V. Kalyaan Singh, learned counsel for the petitioner; learned Assistant Government Pleader for Municipal Administration and Urban Development, appearing for respondent No.1; Mr. P. Krishna Reddy, learned Standing Counsel for Municipality, appearing for respondent No.2; learned Assistant Government Pleader for Home appearing for respondent No.3; Mr. Rajkumar Gummi, learned counsel appearing for respondent No.4.
Learned counsel for respondent No.4 submitted that before granting building permission to respondent No.4, the complaint of the petitioner was considered, documents were verified and after obtaining legal opinion from the concerned Assistant Government Pleader the objections of the petitioner were rejected.
However, learned counsel for the petitioner submitted that documents which were submitted by the petitioner and explanation given by him has not been considered. As such, the petitioner has submitted detailed explanation/objections through legal notice dated 18.05.2026 for cancellation of building permission of respondent No.4. The petitioner instituted perpetual injunction suit in O.S. No.66 of 2023 against respondent No.4 and counter suit in O.S. No.25 of 2024 has been filed by respondent No.4 in the Court of the learned Junior Civil Judge at Bichkunda. Both the suits are pending and hence, requested this Court to pass interim orders until interim orders are passed by the trial Court.
In the light of the above said submissions, this writ petition is disposed of directing respondent No.2 to consider the representation of the petitioner submitted by way of legal notice dated 18.05.2026, seeking cancellation of building permission granted to respondent No.4 in File No.001745/BICH/00001/IR/2025 dated 18.03.2026 within a period of four (04) weeks from the date of receipt of a copy of this order by affording opportunity of personal hearing to the petitioner and respondent No.4. Construction, if any, undertaken by the petitioner, shall be subject to outcome of such enquiry and orders that may be passed in O.S. Nos.66 of 2023 and 25 of 2024. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
