This Criminal Petition under Sections 437 and 439 of Code of Criminal Procedure (for short ‘Cr.P.C.’), has been filed by the petitioners/Accused Nos.3 and 5, seeking regular bail in Crime No.355 of 2023 of Bommuru Police Station, Visakhapatnam District, registered for the offence punishable under Sections 8(c) read with 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the NDPS Act).
The case of the prosecution in nut shell:
On 17.11.2023 at about 4.45pm, the Inspector of Police along with their staff and mediators reached house bearing D.No.104-5-491, 10th street, Ramakrishnanagar, Hukumpeta of Rajamahendravaram Rural Mandal, noticed silver colour Mahindra Bolero Neo car bearing No.AP 39 RC 8008 and Swift Grey Colour car bearing No.AP 31 AY 0043 and five persons who are A1 to A5 and on search found 306.675kgs of ganja and the same was seized along with vehicles under cover of mediators report.
Heard Sri Duggirala Subash, learned counsel for the petitioners and Ms. D.Prasanna Lakshmi, learned Assistant Public Prosecutor representing the State/Respondent.
Learned counsel for the petitioners would submit that charge sheet has not been filed though statutory period is over.
Learned Assistant Public Prosecutor opposed the petition.
At this juncture, since the claim is for statutory bail, learned counsel for the petitioner is permitted to file an appropriate petition before the Special Court and the Special Court may pass appropriate orders if no extension has been given so far.
Accordingly, the Criminal Petition is disposed of.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
