Judgment
Arindam Lodh, J
Heard Mr. D. Datta, learned counsel appearing for the applicant. Also heard Mr. R. Saha, learned Additional PP appearing for the respondent-State.
This is an application filed under Section 438 Cr.P.C. for granting anticipatory bail in connection with Belonia PS case No. 43 of 2024 registered under Sections 370/120-B/212 of the IPC and Section 3 of the IPP (Entry into India) Act, 1920.
Mr. Datta, learned counsel for the applicant has submitted that altogether there are three accused persons allegedly involved with the offence, and two of them have already been enlarged on bail by the learned trial court. As such, the present applicant has approached this court for enlarging him on anticipatory bail.
Mr. Saha, learned Additional PP has submitted that the learned trial court enlarged both the co-accused persons on bail after their surrender, so the present applicant may approach the trial court for granting him bail.
Considered the submission of learned counsel appearing for the parties. Since, two co-accused persons were enlarged on bail by the trial court after their surrender, so this court is of the view that, the present applicant shall also surrender before the trial court.
Accordingly, the applicant is directed to surrender before the trial court. On his surrender, if the applicant prefers any bail application, the trial court, while considering his bail application shall keep in mind that two co-accused persons involved with the alleged offence have already been enlarged on bail
With the above observation and directions, the instant application stands disposed of.
