Heard both the sides.
This bail application has been filed on behalf of Phani Bhushan Mahato @ Phani Bhusan Mahato who is in custody since 02.09.2025 in connection with Ichagarh P.S. Case No. 31 of 2025 for the offence registered under Sections 417, 420, 465, 467, 468, 471 and 34 of the IPC pending in the Court of learned Addl. Chief Judicial Magistrate at Chandil is pressed into motion.
As per the FIR, this petitioner along with other two co-accused persons induced the informant on a false promise to provide employment in postal department to give Rs. 2,00,000/- and embezzled the said sum and job was also not provided.
It is submitted by the learned counsel on behalf of petitioner that not a single penny was received by this petitioner and there is no material to show that any amount was credited to his account. Further, it is also submitted that court proceeding cannot be used for realization of amount which was advanced for illegal purpose.
Learned A.P.P. opposed the prayer for bail.
I find the argument on behalf of the petitioner to be persuasive enough for grant of bail.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
