Judgment
Kurian Joseph, C.J.—The writ petition is filed with the following prayer:
(i) That by issuance of writ of certiorari impugned transfer orders dated 3.4.2011/7.5.2011 under No. EDN-CHM(Ele)-iv(transfer)/2009-10-3960-72 issued by Deputy Director Elementary Education Respondent No. 3 qua Petitioner Annexure P-10 may be quashed and set aside. And further by issuance of writ of mandamus Respondents particularly Respondents No. 2 and 3 may be directed to transfer Petitioner/CHT from Govt. Centre Primary School, Bajol, Block Garola,Tehsil Bharmour District Chamba HP hard/difficult area and adjust Petitioner to one of station of his choice as mentioned in the Para 4(B) of writ petition in the light of Annexure P-1 to P-9.
According to the Petitioner, his transfer from hard area to soft area in terms of the policy has not been considered. The representations Annexure P-3 to P-8 are pending. Annexure P-9 is the lawyer notice. There will be a direction to the first Respondent to look into those representations and take appropriate action adverting to the submissions made therein, in accordance with law within a period of three weeks from the date of production of a copy of this judgment along with a copy of the writ petition by the Petitioner before the first Respondent. Till orders are passed, as above, in case the Petitioner has not been relieved, he shall be permitted to continue at Government Primary School, Bajol, the hard area.
The writ petition is disposed of, so also the pending applications, if any.
