Judgment
Tashi Rabstan, J
After hearing the matter for a while, learned counsel for the parties jointly stated at the bar that this appeal can be disposed of provided a direction is given to the learned Principal District Judge, Udhampur to consider and decide application filed by the respondents for appointment of commissioner. Learned counsel for the parties further stated that the commissioner be given specific time to submit his report and till then the order impugned herein shall be kept in abeyance. Their statement is taken on record.
In view of the statement made by learned counsel for the parties this appeal is disposed of with a direction to the learned Principal District Judge, Udhampur to appoint a commissioner directing him/her to submit a report within a period of two weeks from today, in the terms and conditions provided by the learned Principal District Judge, Udhampur. Upon receipt of report of the commissioner, the learned Principal District Judge, Udhampur shall pass a fresh order strictly under rules and till such fresh order is passed the impugned order shall be kept in abeyance.
Disposed of as above.
