This is an application complaining that there is a medicine manufacturing unit of Mr. Hem Raj Goel and Mr. Sunil Goel, constructed on an agricultural land situated in village Threeke, adjoining Railway Line, Bajaj Colony, Near Grewal Diary, Threeke Road, Ludhiana (Punjab), which is being run illegally in as much as they have not obtained any permission/clearance/NoC under environmental laws but causing pollution by discharging their effluent in soaking pits causing contamination of underground water.
The applicant though has named violators in the original application but the alleged violators have not been impleaded and in absence of these violators being party to the application, no action on our part would be justified at this stage.
In our view, the matter may be examined by State PCB and if they find any violation of environmental laws, they may take appropriate remedial action in the matter.
We, accordingly, dispose of this application by permitting applicant to approach State PCB and make appropriate application and if such an application is made the concerned officials of State PCB shall examine the matter and find out whether the unit in question is working in accordance with the norms and statutory provision of environment. If it finds any violation thereof, it may take appropriate remedial action in the matter, very expeditiously.
If the applicant is not satisfied with the action taken by State PCB, he has liberty to approach appropriate higher authorities in the matter or the Tribunal, as the case may be.
