Judgment
By filing this writ petition, the petitioner has prayed for the following reliefs:-
"for issuance of an appropriate writ(s)/order(s)/direction(s) or a writ in the nature of Mandamus for restoration of Petitioner's PDS License No.KA-01/2001 by setting aside the order dated 04.07.2023 having Memo No.775(ii)/Supply issued by the District Supply Officer, Khunti (Annex-1), whereby the Petitioner's PDS License No.KA-01/2001 was suspended; and further;
AND/OR Issuance of a Writ in the nature of Mandamus directing the concerned Respondents to declare the said suspension as having automatically lapsed by operation of law, restore the Petitioner's license and grant all consequential benefits."
Heard learned counsel representing the petitioner and learned counsel representing the respondents.
By an order as contained in Letter bearing Memo No.775 dated 04.07.2023, passed by the District Supply Officer, Khunti, the PDS License of the petitioner being License No.KA-01/2001, was suspended on the allegation of some irregularities.
It is the grievance of the petitioner that till date his license is suspended and no final decision has yet been taken.
Considering the fact that till date, the license of the petitioner is under suspension, the petitioner is directed to file his objection before the District Supply Officer, Khunti (respondent No.3), within four weeks from today.
After filing of objection by the petitioner, the District Supply Officer, Khunti, after giving an opportunity of hearing to the petitioner, will take a final decision as to whether the suspension of license should be revoked or license of the petitioner should be cancelled. The said decision should be taken by passing an appropriate order, within eight weeks.
The said order should be communicated to the petitioner immediately.
With the aforesaid observations and directions, this Writ Petition stands disposed of.
