The petitioner herein is the third applicant in S.M.Proceedings No.1184/2009 of the Land Tribunal, Manjeri and the third respondent in A.A. No.96/2009 of the Appellate Authority (LR), Thrissur. The petitioner seeks expeditious disposal of the above referred S.M.Proceedings.
This Court called for a report from the said Appellate Authority, as regards the time required for disposal of A.A. No.96/2009. As per letter dated 28.12.2023, it has been informed that the subject land is situated within the jurisdiction of the Land Tribunal, Tirurangadi, and that the S.M. No.1184/2009 will be forwarded to the Land Tribunal, Tirurangadi, for taking a decision on the file. The Appellate Authority seeks 12 months' time to dispose of the matter.
Having perused the report and having heard the learned counsel for the petitioner, this Court is of the opinion that 12 months' time sought for in respect of an S.M. Proceedings of the year 2009 is excessive. This Court, therefore, directs the Land Tribunal, Tirurangadi, as also, the Appellate Authority, Thrissur, to ensure that S.M. Proceedings No.1184/2009 is tried and disposed of within a period of six months from the date of receipt of a copy of this judgment.
The Original Petition is disposed of, as above.
