This Criminal Petition, under Sections 437 and 439 of Cr.P.C. (New Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023), is filed by the petitioners/A.1 and A.5 seeking regular bail in Crime No.154 of 2024 of Narasaraopet Rural Police Station, Palnadu District, registered for the offences punishable under Sections 307 and 324 read with 34 I.P.C.
Heard Sri D.Purna Chandra Reddy, the learned counsel for the petitioners and the learned Assistant Public Prosecutor for respondent-State.
Perused the record.
Case diary discloses that there are five accused in this crime. The victim party belonged to Telugu Desam Party and the accused belonged to YSR Congress Party. The allegations are that on 17.06.2024 during evening hours the accused party attacked the victim party with rods and sticks and caused injuries to three persons. So far eleven witnesses were examined. A.2 to A.4 were arrested and were remanded to judicial custody and were granted regular bail on 25.07.2024 by the learned XIII Additional District and Sessions Judge, Narasaraopet in Crl.M.P.No.292 of 2024. The present petitioners were arrested on 21.06.2024 and they have been in judicial custody. A.1 is a woman and medical record is shown about the ailment she has been suffering from. A.5 is her son. Allegations against them indicate that they only beat with hands and legs.
Considering the length of detention and progress in investigation, any further detention does not seem necessary. Therefore, prayer is granted.
In the result, this Criminal Petition is allowed. Petitioners/A.1 and A.5 shall be enlarged on bail on each executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional Civil Judge (Junior Division), Narasaraopet. Petitioners/A.1 and A.5 shall mark their attendance before the Investigating Officer on 1st and 15th of every month between 10.00 AM and 1.00 PM for a period of three (3) months. Petitioners/A.1 and A.5 shall make themselves available for investigation by a police officer as and when required, and they shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. They shall not indulge in similar acts of crime.
