Crl. Misc. No. 63252 of 2010:

This is an application for restoration of the petition which was dismissed for non-prosecution vide order dated 30.11.2010.

Learned Counsel for the applicants-Petitioners submits that inadvertently he noted a wrong date in the case due to which he could not appear on 30.11.2010.

For the reasons stated in the application, same is allowed. The case is restored to its original position and number.

Crl. Misc. No. M-34179 of 2010:

This is a petition u/s 438 Code of Criminal Procedure.seeking pre-arrest bail in a case wherein Petitioners have been summoned to face trial for offence u/s 3(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned Counsel for the Petitioners submits that he may be allowed to withdraw this petition with liberty tithe Petitioners to appear before the trial court and seek regular bail. He, however, prays that some protection may be afforded to the Petitioners in order to enable them to appear before the trial court.

Dismissed as withdrawn with liberty as aforesaid.

It is, however, directed that in case the Petitioners surrender before the trial court within ten days from today and apply for regular bail, same shall be decided within a week thereafter. Arrest of the Petitioners shall remain stayed till the decision of their bail application.
