Judgment
Rajan Gupta, J.—This is a petition u/s 438 Code of Criminal Procedure seeking pre-arrest bail in a case in which the Petitioner has been summoned to face trial vide order, Annexure P-2 for commission of offence u/s 3 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Sections 420 and 506 IPC.
After arguing at some length, learned Counsel for the Petitioner submits that he may be allowed to withdraw the present petition with liberty to the Petitioner to surrender before the court below and seek regular bail. He, however, submits that some protection may be afforded to the Petitioner to enable him to appear before the court below.
In view of the statement made by learned Counsel for the Petitioner, this petition is dismissed as withdrawn with the liberty as aforesaid. In case the Petitioner surrenders before the court below within ten days from today and applies for regular bail before the competent court, his plea shall be decided within three days thereafter. Arrest of the Petitioner shall remain stayed till the decision of his bail application.
