The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of memo/replies dated 06.11.2003 and 20.11.2003 (Annexures P-5 & P-6) whereby respondent has rejected his claim for higher pension.
The petitioner was promoted as Deputy Superintendent of Police (‘DSP’) w.e.f. 14.07.1981. He was granted senior pay scale of ₹2200-4000/- w.e.f. 18.07.1986. He retired on 31.05.1987. He claims that as per Government instruction dated 07.01.1998 pay scale of DSP after 5 years of regular satisfactory service is ₹10,000-13,900/-. As per Government instruction dated 07.01.2002, pension of the petitioner needs to be refixed in the pay scale of ₹10,000-13,900/-. The respondent has rejected petitioner’s claim on the ground that pay scale of ₹10,000-13900 is payable to directly appointed DSP. The petitioner was granted pay scale as per his entitlement.
There is no representation on behalf of the petitioner. It appears that with the efflux of time, he has lost his interest to pursue the present petition.
In the backdrop, the petition stands dismissed.
The petitioner is at liberty to move an appropriate application within three months if cause survives.
