The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent to grant 05 marks under Socio-Economic Criteria and revise their result.

The petitioners pursuant to Advertisement No.04/2020 applied for the post of Constable. The petitioner No.1 claimed benefit of Socio-Economic Criteria and petitioner No.2 claimed EWS. As per Advertisement, there were 05 marks for Socio-Economic Criteria. The petitioner No.1 was denied 05 marks on the ground that she did not submit requisite affidavit in prescribed form.

Learned counsel representing the parties are ad idem that Division Bench of this Court has set aside Socio-Economic Criteria, however, review petitions are pending. If review petitions are dismissed, result would be revised.

Learned counsel representing the respondents submits that petitioner No.1 would be reconsidered as and when result is revised on account of setting aside of Socio-Economic Criteria. If review petition is allowed, the petitioner may move an appropriate application before this Court seeking revival of the petition. The petitioner No.2 is ineligible because of filing incorrect EWS Certificate.

Learned counsel representing the petitioner expressed his inability to controvert claim of respondent qua petitioner No.2 and agreed with the statement of State counsel qua petitioner No.1.

Disposed of in above terms.
