Judgment

Heard learned CGC who has submitted that some factual instructions has been received from the department, information which are relevant for consideration of the dispute between the parties herein and as such, it is prayed that the same may be allowed to be filed by way of an affidavit.
Learned counsel for the petitioner has vehemently objected to the same on the grounds that this matter has travelled since the year 2016 and at this point of time to introduce new facts and documents may not be tenable.
This Court on consideration of the submissions made would reiterate that in a dispute to be adjudicated between the parties, a level playing field has to be given to the parties with a fair chance for the parties to place their best arguments before the court. Accordingly, on this premise, the prayer of the learned CGC is allowed.
However, it is made clear that the said affidavit has to be filed on the next date fixed failing which the matter shall proceed without affording any more opportunity to the respondent.
