Judgment
Ravindra Maithani, J
Applicant Pankaj Yadav is in judicial custody in FIR No. 195 of 2022, under Sections 147, 148, 149, 323, 307, 341, 504 and 506 IPC, P.S. Transit Camp, District Udham Singh Nagar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
It is argued that co-accused having similar role has already been granted bail.
Learned State Counsel would submit that the eye witness has supported the prosecution case.
According to the FIR, on 29.05.2022, at about 11:00 a.m., the co-accused assaulted and fired at the informant. The informant is the victim. In his statement during investigation, he has stated that it is the co-accused Manoj Chauhan, who had fired at him. Admittedly, the co-accused Manoj Chauhan has already been granted bail.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be enlarged on bail on his executing personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
