Judgment
Ravindra Maithani, J
Applicant- Saurabh is in judicial custody in Case Crime No.130 of 2023, under Sections 147, 148, 149, 307 IPC, Police Station- Kotwali Gangnahar Roorkee, District- Haridwar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the FIR, on 03.03.2023, at about 7:00 in the evening, the injured was fired by the co-accused.
Learned counsel for the applicant would submit that the injury is not on the vital part; applicant is not named in the FIR; during investigation, his name was revealed, but he is not the actual person, who hit the injured.
Learned State Counsel would submit that post lodging of the FIR, the applicant’s name came on surface during investigation, but, she admits that the applicant is not the actual shooter.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
