This petition is filed under article 226 of the Constitution of India by the petitioner herein who is arrayed as 1st accused in Crime No.717 of 2014 of Kondotty Police Station seeking the following relief:

"Issue a writ of mandamus or other appropriate writ, order or direction commanding the 1st respondent to file the final report in Crime No.717/2014 of Kondotty Police Station, Malappuram District before the Court having jurisdiction within a reasonable time this Hon''ble Court deem fit.

It is discernible from the statement filed by the learned Government Pleader, as directed by this Court that investigating officer has concluded that the offence under Section 376 is not made out against the petitioner herein. It is further stated that the investigating agency does not intend to prosecute the petitioner. It is also submitted that the report to that effect shall be filed before the jurisdictional court without delay. In that view of the matter, this petition is closed with a direction to the Inspector of Police, Kondotty to file appropriate report before the jurisdictional court without any further delay.
