Judgment
Augustine George Masih, J
Learned counsel for the State, on instructions from Ms.Ritu, Senior Assistant, Revenue Department, informs the Court that it is the petitioner who is not appearing before the Court, when the case is taken up for hearing and only proxy counsel has been appearing for the petitioner. He further informs the Court that the next date of hearing in the revision as well as stay application is 16.09.2019.
Counsel for the petitioner undertakes that the petitioner would appear before the Financial Commissioner on the date fixed i.e. 16.09.2019 and argue the revision as well as stay application.
In view of the above, direction is issued to the Financial Commissioner, Punjab, to consider and decide the revision, if possible and in any case the stay application on the said date. It is made clear that in case the counsel for the petitioner does not appear before the Financial Commissioner, Punjab, on the date fixed, still he would proceed to decide the case in accordance with law.
The writ petition is disposed of with the above observations.
