Petitioner has filed the instant petition seeking a mandamus to direct the 1st respondent i.e. the Financial Commissioner, Punjab to take a final decision
on a revision petition preferred by the petitioner under Section 16 of the Punjab Land Revenue Act and which was filed in November, 2020.
Counsel submits that the revision petition had been preferred assailing the order dated 05.07.2016 vide which Sanad Taksim had been issued by the
Assistant Collector 1st Grade, Chhabaal Kalan (Annexure P-8) as also connected proceedings. It is submitted that along with the revision petition,
other applications had also been filed seeking condonation of delay in filing the revision petition as also seeking certain interim directions. It is
contended that the revision petition as also the accompanying applications are not being taken up for consideration and to the prejudice of the
petitioner. Court has further been informed that matter already stands adjourned to 09.07.2021.
Since an advance copy of the petition already stood served upon State of Punjab, Mr. Abhay Pal Singh Gill, learned AAG, Punjab upon instructions
from Rajesh Sharma, Reader to Sh. Sanjay Kumar, IAS, Financial Commissioner (Appeals), Punjab submits that in case the petitioner moves an
application seeking preponement of the date in revision petition, the same would be entertained, a short date would be fixed and the applications
accompanying the revision petition would certainly be decided.
Statement is accepted.
Writ petition is disposed of with the observations that in case the petitioner moves an application seeking preponement of hearing in the revision
petition as also the accompanying applications within a period of one week from today, the date would then be preponed from 09.07.2021 and the
same would be set down for hearing on a short date at the convenience of the 1st respondent. The Financial Commissioner, Punjab would then make
an endeavor to take a decision on the applications accompanying the revision petition i.e. seeking condonation of delay as also seeking interim
directions expeditiously.
It is clarified that this Court has not examined the issue on merits.
Disposed of.
