The 8th respondent is the wife of the 1st petitioner. She had initially filed a complaint against the petitioners, for offences under Sections 498-A r/w Sections 3 & 4 of Dowry Prohibition Act, before the 6th respondent, which was registered as Crime No.180 of 2022 of 30.09.2022. Thereafter, the 8th respondent is said to have filed a fresh complaint before the 7th respondent on the very same allegations attracting the same offences. This complaint was also registered as Crime No.548 of 2022 on 02.11.2022.

The petitioners have approached this Court with the complaint that both the respondents 6 and 7 are calling the petitioners to appear before them and are harassing the petitioners. The petitioners would submit that filing of a second complaint itself is not maintainable and consequently, the petitioners cannot be summoned to the police stations, by the 6th and 7th respondent.

The learned Assistant Government Pleader, on instructions, submits that the 7th respondent having come to know of the earlier complaint filed before the 6th respondent has now closed Crime No.548 of 2022 on the ground of mistake of fact.

In the circumstances, the investigation in Crime No.180 of 2022 may go on according to law.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
