P. Tania Vaishnav vs T. Naveen Kumar

Pursuant to Order dated 3­7­2018 passed by us, we directed both the parties to appear before the Mediator, Mediation Centre, High Court of Madras on 6­9­2018 at 11.00 a.m.

As per the Mediation Report dated 29­11­2018, mediation has been completed and no agreement has been reached between the parties.

This petition under Section 25 of the Civil Procedure Code, 1908 read with Order XLI of the Supreme Court Rules, 2013 has been filed by the petitioner (wife) for transfer of case being H.M.O.P. No.1882 of 2017 titled as "T. Naveen Kumar vs. P. Tania Vaishnav" pending before the Additional Family Court at Chennai, Tamil Nadu to the District and Sessions Court, Andaman and Nicobar Islands, Port Blair.

Having heard the learned counsel appearing for the parties and taking into consideration the grounds taken in the transfer petition, we direct transfer of case being H.M.O.P. No.1882 of 2017 titled as "T. Naveen Kumar vs. P. Tania Vaishnav" pending before the Additional Family Court at Chennai, Tamil Nadu to the District and Sessions Court, Andaman and Nicobar Islands, Port Blair.

Let the record of the case be transferred without delay.

The Transfer Petition is allowed in the afore­stated terms.
