This Criminal Petition, under Section 438 of Cr.P.C., has been filed by the petitioner/A1, seeking anticipatory bail, in Crime No.14 of 2022 of Nagari Urban Police Station, Chittoor district.

A case has been registered against the petitioner herein and another for the offences punishable under Sections 420 and 409 read with 34 IPC.

The accusations made as against the accused as per the FIR are that both the accused Nos.1 and 2, who worked as Manager and Cashier respectively in Axis Bank, Prakasam Road branch, Nagari Municipality, Chittoor district, colluded together and misappropriated an amount of Rs.14,50,000/- by issuing fabricated fixed deposits to the customers.

Heard. Perused the record.

On a perusal of the entire material on record goes to show that the petitioner herein has deposited an amount of Rs.14,50,000/- into the accounts. Accusations are made as against accused No.2 also. There is any amount of ambiguity whether the petitioner has been involved in the alleged offence or not. Without going into the merits of the case, since the petitioner herein has deposited the said amount in the accounts, this Court is inclined to grant anticipatory bail to the petitioner herein.

Accordingly, in the event of arrest of the petitioner/A1, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. The petitioner shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. Petitioner/A1 shall attend before the Station House Officer concerned on every Sunday till filing of the charge sheet.
