Judgment
Learned counsel for the applicant states that the applicant’s brother who was in Government service expired on 25.10.2021. Thereafter, within a few days time, the applicant applied for his compassionate appointment in terms of SRO 43 of 1994. Despite a lapse of such a long time, the respondents have neither appointed him nor rejected his case. Hence, this OA.
Learned counsel for the applicant, therefore, prays that he would be satisfied if the respondents are directed to consider the representation dated 23.11.2021 of the applicant and dispose of the same by passing a speaking order within a stipulated time frame. He also places before this Tribunal a copy of the judgment dated 20.05.2022 passed by Hon’ble Apex Court in Civil Appeal No. 4103 of 2022 arising out of SLP(Civil) No. 936/2022.
On the other hand, learned counsel for the respondents states that this case would be considered as per the extant rules on the subject.
4 Heard Mr. Parvaiz Lone for Mr. Sameer Hassan Dar, learned counsel for the applicant and Mr. Waseem Gul, learned GA, and perused the records.
In view of the prayer made by the learned counsel for the applicant, the respondents are hereby directed to consider the representation dated 23.11.2021 of the applicant and dispose of the same by passing a reasoned and speaking order within a period of four weeks from today. A copy of the speaking order be given to the applicant.
It is made clear that I have not entered into the merits of the case. This disposes of OA No. 780/2022 accordingly. No order as to costs.
