Judgment
K.S. Jhaveri, J.—This application u/s 29(2) of the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947 is directed against the judgment and order dated 07.02.1998 passed by the learned Extra Assistant Judge, Baroda in Civil Misc. Appeal No. 281 of 1996 whereby the learned judge has dismissed the appeal preferred by the applicant by confirming the order dated 20.07.1996 passed by the trial Court below Exh. 5 in Rent Suit No. 214 of 1996 restraining the applicant-Corporation from enhancing the rent of the suit premises till final disposal of the suit.
Heard the learned advocates for the respective parties. As a result of hearing of this exercise and in view of the fact that suit is of the year 1996, if the application is decided on merits, it may prejudicially affect the contentions of either parties. In that view of the matter, the trial Court is directed to decide and dispose of the suit before 31.12.2011. The parties will be governed by the order passed by the trial Court below Exh. 5 in Rent Suit No. 214 of 1996 till disposal of the suit.
With the above observation, the Civil Revision Application stands disposed of Subject to the above, rule is discharged with no order as to costs.
