Heard counsel for the parties. The petitioner had approached this court for directing the respondents to apply the marker testing procedure as per Clause (c) as decided in the meeting held on 14th February 2008 (Annexure-8) by the respondent Corporation.
This writ petition appears to be misconceived as earlier, the petitioner had moved against the termination of the dealership of his retail outlet of motor spirit and high speed diesel in WPC No. 5765/07 which was dismissed vide judgment dated 20th December 2007 and even letters patent appeal being LPA No. 16 of 2008 preferred against the said judgment, was also dismissed vide judgment dated 6th February 2008. The petitioner has now come before this court by making a prayer in a masked manner to get the same relief of restoration of dealership of his retail outlet, which appears to be an abuse of the process of the court and this court is not inclined to grant any relief. Accordingly, the writ petition is dismissed.
