Judgment
Kurian Joseph, C.J.—The Petitioner has filed the writ petition with the following prayers:
(i) That the Respondent-University may be directed to release the higher scales of Rs. 3000-4500 on completion of 8 years from 31.8.1995 and the Revised Pay Scales of Rs. 10025-15100 w.e.f. 1.1.1996 with all pay fixation benefits along with arrears, forthwith.
(ii) That the Respondents may be directed to release the higher pay scales of Rs. 10025-15100 w.e.f. 1.1.2004 with all pay fixation benefits, along with arrears forthwith.
(iii) That the action of withholding/denying the higher pay scale of Rs. 3000-4500 (revised to 10025-15100) in violation of HPCS(RP) Rules and in violation of Rules 5.6.(1) of the Statutes and the Law may kindly be quashed and set aside.
It is seen from the reply that the matter is under the consideration of the first Respondent. In the above circumstances without expressing any opinion as to the merits of the case and having heard the learned Counsel on both sides, the writ petition is disposed of as follows:
There will be a direction to the first Respondent to take a decision in the matter in accordance with law within two months from the date of the production of a copy of this judgment. In the process, Annexure A-3, the proceedings dated 5.1.2001 whereby the Board of Management had already approved the grant of pay scales at par with the employees in the Government will also be considered by the Respondents. The benefits, if any, flowing out of the said consideration shall be disbursed to the Petitioner within another one month.
