Heard learned counsel for the petitioner and learned counsel for respondent no. 2.  Respondent no.1 is being proceeded ex-parte.

In the light of orders passed by this Tribunal on 27.9.2019 and 4.2.2020, petitioner has preferred M.A. no. 195 of 2021 seeking impleadement of the Authorised Officer under the provisions of Cable Television Networks (Regulations), Act, 1995. As per affidavit of service already filed notice has been served on 30.8.2021 and 28.9.2021.  On order for impleadment of Authorised Officer was postponed only to give last opportunity to Authorised Officer to appear and bring on record the relevant materials as well as take a stand in respect of prayer for his impleadment.  He chose not to appear on 9.11.2021.  Today also nobody appears for Authorised Officer, proposed respondent no. 3.

After hearing the parties and going through the earlier orders, the prayer for implement of respondent no. 3 is allowed.  M.A. No. 195 of 2021 thus stands allowed and disposed of.

Considering the fact that Authorised Officer, in spite of petitioner having approached him under the directions of this Tribunal, has not responded so far and has not submitted any report or reply, it is deemed proper to issue notice upon respondent no. 3 to do the needful and inform this Tribunal of  relevant facts and submit a report by the next date, failing which action under Section 20 of the TRAI Act may be initiated  against respondent no. 3.  Let this order be communicated to respondent no. 3 at the given addresses within two weeks. Petitioner would also be at liberty to serve the copy of this order, Dasti on respondent no. 3.

Post the matter under the same head on 4.2.2022.
