Judgment
A. S. Chandurkar, J
1] Rule. Rule made returnable forthwith. Heard finally with the consent of the learned Advocates for the parties.
2] The petitioner- Society had made an application on 07.01.2020 to the Joint Director of Higher Education seeking permission to initiate recruitment process with regard to five posts of Assistant Professor. During pendency of the present writ petition that was filed for a direction to consider the aforesaid proposal, it is submitted that the State Government has issued a further Government Resolution dated 12.11.2021 thereby permitting initiation of process for filling in 2088 post of Assistant Professor.
3] In this background, it is submitted by the learned counsel for the petitioner that since one of the requirement is that there should be no pending proceedings in Court with regard to the aforesaid subject, the petitioner be permitted to make a fresh application for grant of permission to undertake recruitment as per the new policy.
4] In view of the aforesaid, the petitioner is permitted to make a fresh application seeking grant of permission to recruit the necessary staff in terms of Government Resolution dated 12.11.2021. If such application is made the same shall be considered on its own merit and in accordance with law.
5] Consequently, the earlier application dated 07.01.2020 would now not survive for consideration. The points raised in this writ petition are kept open.
The writ petition stands disposed of. No costs.
The Civil Application No.2124/2021 stands disposed of accordingly.
