The Writ Petition is filed seeking to declare the Circular bearing No.RC/ENC(Admin)/A2/7869786/2023, dated 15.12.2023, and in not considering the case of Petitioner for promotion, relaxation and appointment by transfer upon completion of the requisite qualifying service as illegal and arbitrary. During the pendency of the Writ Petition, Respondents passed a speaking Order bearing No.RC/ENC/AS/22121507/2022, dated 12.03.2024, rejecting the claim of Petitioner on the ground that he had not completed the requisite three (03) years of service in the feeder category and had rendered only sixteen (16) months of service in the cadre of JTO. The said Order has been placed on record by Respondents along with their counter-affidavit.

The grievance of Petitioner in the present Writ Petition is with regard to non-consideration of his case for promotion. However, in view of the subsequent consideration of his case by Respondents and the passing of the aforesaid speaking Order, the grievance raised in the present Writ Petition no longer survives for consideration. If the Petitioner is aggrieved by the said speaking Order, it is open to him to question the same in accordance with law.

Accordingly, the Writ Petition is closed, leaving it open to Petitioner to avail the appropriate remedy, including filing a Writ Petition challenging the Order bearing No.RC/ENC/AS/22121507/2022, dated 12.03.2024, if so advised. There shall be no order as to costs.

No order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed.
