Judgment
Prashant Kumar, J.—Anticipatory bail application filed by Petitioner Nitish Kumar is moved by Sri. Sameer Saurabh and opposed by Sri R.C.P. Sah, learned Additional P.P.
At paragraph 8 of the case diary, it has been alleged that Petitioner assaulted one Jayant Kumar with Rod and inflicted several injuries. However, from perusal of entire case diary, I find that there is no injury report of Jayant Kumar though injury reports of two others are available in the case diary.
Considering the aforesaid facts and circumstance, I allow this application and direct the Petitioner to surrender in the court below by 8.4.2011 and in that event the court below is directed to enlarge the Petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ranchi in connection with Jagarnathpur P.S. Case No. 71 of 2010 ( G.R. No. 1095 of 2010), subject to the condition as laid down u/s 438(2) of the Code of Criminal Procedure.
