Learned counsel for the petitioner Mr. Shashi Bhushan is present.
Learned counsel for the opposite party-state Mr. Rakesh Kumar Roy is present.
This petition has been filed for restoration of W.P. (S) No. 1717 of 2014 which was dismissed for non-compliance of order dated 13.06.2017 on account of non-removal of defects within the peremptory time. The learned counsel for the petitioner submits that due to unavoidable circumstance, the defect could not be removed and he submits that the defects in the writ petition will be removed within the time as may be directed by this court.
Learned counsel for the opposite party has no serious objection to the prayer made.
Considering the aforesaid submissions, C.M. P. No. 217 of 2017 is hereby allowed and the one week time which was granted by this court in W.P. (S) No. 1717 of 2014 vide order dated 13.06.2017 is now extended till 31.03.2022.
If the defects are removed within 31.03.2022, office is directed to place the writ petition before appropriate Bench as per roster.
