On 22-11-2022, when the notice was issued in the matter, Shri Th. Sukumar, learned Government Advocate accepted notice on behalf of the respondent Nos. 1 and 2 and accordingly, the learned counsel appearing for the petitioner was directed to serve notice upon the respondent Nos. 3 and 4 by dasti.
From the office report dated 10-12-2021, it is seen that the respondent Nos. 3 and 4 had been served with the notice for which, an additional affidavit was filed by the petitioner stating therein clearly that the respondent No. 3 was served on 25-11-2021 and respondent No. 4 was served with the notice on 27-11-2021 respectively. Therefore, service is complete upon all the respondents. However, when the matter is taken up for consideration, no one has entered appearance on behalf of the respondent Nos. 3 and 4 nor is any of their officials present before this court in the matter.
Shri N. Jotendro, learned Senior Advocate appearing for the petitioner humbly submits that his interim prayer may be considered today for the reason that in case the result of the said Interview is declared before any interim order is granted by this court, the writ petition will become infructuous.
Admittedly, the process of recruitment did commence long back and Interview had also been held pursuant to the advertisement dated 19-12-2020. The main grievance of the petitioner is that his eligibility had been rejected wrongly by the respondents because of which, the petitioner was not given an opportunity to participate in the recruitment process.
List the matter on 18-01-2022 for disposal
In view of the urgency involved in the matter and the peculiar facts and circumstances of the case, Shri Th. Sukumar, learned Government Advocate is permitted to file his counter by the next date. Respondent Nos. 3 and 4 are also permitted to file their counter by the next date. By way of an interim measure, it is directed that the result of the recruitment process initiated pursuant to 19-12-2020 shall not be declared till the next date only in respect of the subject of Zoology.
