The petitioner has approached this Court complaining that the third respondent is not even accepting the application preferred by her for the purpose of issuance of a Non Creamy Layer Certificate to her son; and thus prays that the same be directed to be allowed as per law, within a time frame to be fixed by this Court.

Sri.Sunil Kumar Kuriakose – learned Government Pleader, submitted that the afore submission of the petitioner, as made by her learned counsel -Sri.Sibi Thomas Jacob, is not correct, because the third respondent is obligated to accept all applications; but that he can issue necessary orders thereon, only as per law and after making necessary enquiries. He submitted that, therefore, if this Court is so inclined, the third respondent is willing to accept any application of the petitioner, provided it is made in proper format and that he will consider the same and issue appropriate orders, as per law.

No doubt, the afore submissions of the learned Government Pleader would allay the apprehension of the petitioner substantially, if not fully.

Resultantly, I allow this writ petition and direct the third respondent to accept any application to be made by the petitioner, or by her son and to consider the same in terms of law, after making necessary enquiries. The final order in this regard shall be issued not later than two weeks from the date on which the application is so preferred.
