Judgment
Per: Ms. Urmita Datta (Sen), Member (J)
Heard Ld. Counsel on both the sides.
At hearing, Ld. Counsel for the applicant fairly submitted that though the applicant had challenged the institution of disciplinary proceedings against him, however, in the meantime, he has been exonerated vide order dated 27.07.2026 as per the order of the President. A copy of the said order has been brought on record by Ld. Counsel for the respondents who concurs with the submission made on behalf of the applicant.
Ld. Counsel for the applicant submits that since the grievance of the applicant is redressed, he does not want to pursue the instant O.A. as his main grievance has been redressed and thus the O.A. has become infructuous to that extent. However, Ld. Counsel also prays that consequential benefits arising out of the applicant’s exoneration may be directed to be granted to him in a time bound manner.
In view of the aforesaid submission, the instant O.A. is disposed of. However, the competent respondent authority is directed to grant all consequential benefits, if any, arising out of the order of exoneration dated 27.07.2026 to the applicant within a period of one month from the date of receipt of a copy of this order. There will be no order as to costs.
