The instant petition under Section 482 of the Cr.P.C. has been filed for quashing of the F.I.R. bearing No.2021 EAG 131 dated 07.10.2021 registered in the East Agartala Police Station, Agartala, West Tripura under Sections 420/120B of the IPC against the petitioner and respondent No.3 and also the Charge-sheet dated 17.02.2022 whereby the Investigating Agency has found materials against the accused person/petitioner under Section 420 of the IPC.

Mr. Raju Datta, learned Public Prosecutor, submits that the petitioner is not cooperating in the criminal proceeding and charges have also not been framed. In fact, as a matter of fact, Warrant of Arrest has been issued against the petitioner.

Mr. Somik Deb, learned senior counsel assisted by Mr. Pannalal Debbarma, learned counsel appearing for the petitioner, also does not dispute that the charges have not been framed till date.

Therefore, after some arguments, learned senior counsel for the petitioner, on instructions, seeks permission to withdraw this petition in order to move an application at the appropriate stage for discharge before the concerned Court of Judicial Magistrate 1st Class, Court No.7, Agartala, West Tripura in connection with the instant case.

In view of the prayer made, the petition is dismissed as withdrawn with the aforesaid liberty.
