The instant petition under Section 482 of the Cr.P.C. has been filed for quashing of the F.I.R. bearing No.2019 EAG 215 dated 03.08.2019 registered in the East Agartala Police Station, Agartala, West Tripura under Section 420 read with Section 34 of the IPC and also the Charge-sheet dated 21.07.2020 whereby the Investigating Agency has found materials under Section 420 read with Section 34 of the IPC against the petitioners.
Mr. Raju Datta, learned Public Prosecutor, informs that the petitioner has been dragging the case and till date, charges also could not be framed.
Mr. Somik Deb, learned senior counsel assisted by Mr. Pannalal Debbarma, learned counsel appearing for the petitioners, also does not dispute that the charges have not been framed till date.
Therefore, after some arguments, learned senior counsel for the petitioner, on instructions, seeks permission to withdraw this petition in order to move an application at the appropriate stage for discharge before the concerned Court of Judicial Magistrate 1st Class, Court No.7, Agartala, West Tripura in connection with the instant case.
In view of the prayer made, the petition is dismissed as withdrawn with the aforesaid liberty.
