This original application is registered suo-motu on the basis of the news item titled "Hyderabad Zoo Gets Contaminated Water from Mir Alam Says Chief Wildlife Warden" appearing in the Deccan Chronicle dated 14.04.2024.

The  matter  relates  to  contaminated  water  coming  from  the  Mir Alam Lake to the Nehru Zoological Park in Hyderabad. As per the article, water coming from Mir Alam Lake via channels and drains, was contaminated with metals like nitrates and molybdenum, which post a health hazard to animals.

The above matter indicates violation of the Water (Prevention and Control of Pollution) Act, 1974; Forest Conservation Act, 1980 and Environment Protection Act, 1986.

The news item raises substantial issue relating to compliance of the environmental norms and implementation of the provisions of scheduled enactment.

Power of the Tribunal to take up the matter suo-motu has been recognized by the Hon’ble Supreme Court in the matter of “Municipal Corporation of Greater Mumbai vs. Ankita Sinha & Ors.” reported in 2021 SCC Online SC 897.

Hence, we implead the following as respondents:

(i). Telangana Pollution Control Board, through its Member Secretary, Paryavarana Bhavan, A-3, I.E. Sanath Nagar, Hyderabad -500018.

(ii). Principal Chief Conservator of Forests, Telangana, Aranya Bhavan, Saifabad, Hyderabad, Telangana - 500004.

(iii). Chief Wildlife Conservator, Telangana, Aranya Bhavan, Saifabad, Hyderabad, Telenagana 500004.

(iv). District Collector/District Magistrate, Hyderabad, District Collector Office, 6-2-10, Lakdikapul, Hyderabad-500004

Issue notice to the respondents for filing there response before the appropriate bench of the Tribunal at least one week before the next date of hearing.

Since the matter relates to the Southern Zonal Bench, Chennai, therefore, OA is transferred to the Southern Zonal Bench. Therefore, the original record of this OA be transferred to the Southern Zonal Bench, Chennai for further action.

List before Southern Zonal Bench at Chennai on 31.07.2024.
